Renewal of Tenancy Contract for Residential

      ​- An applicant for the annual subscription in the e-system of tenancy contracts must be a real state office specialized in property management and leasing of lands and all types of real estate, and must hold a trade license issued by the Sharjah Economic Development Department.
      - A subscriber is fully responsible for the logging into its account by a third party, upon his undertaking in the subscription request to be liable for all criminal and civil consequences, without having to submit claims to third parties or waiting for judicial rulings.
      - A subscriber shall not enter any incorrect information or forged attachments for the purpose of carrying out any transaction in the e-system, otherwise the municipality will be entitled to impose fines against and refer the violator to the concerned authorities.
      - A subscriber shall, upon payment of all due amounts on behalf of a tenant, be fully responsible for all fees and fines the subscriber  collects from a tenant in behalf of the municipality whether in cash or securities, and if any financial dispute arises with a third party, the subscriber shall not submit any claims against the municipality, nevertheless the municipality is entitled to submit claims against the subscriber to collect its dues.
      - The municipality is not liable for any damage or loss to any financial transactions uncompleted on the e-system, and such transactions are subject to electronic piracy on a shared computer.
      - The concerned authority may impose fines on a subscriber as set out in the fees and fines schedule shown below if the subscriber fails to monthly renew the tenancy contract on time.
      - The fee for an electronic tenancy contract is to be aligned with the usual fee for a traditional contract.
      - Subject to rules and regulations issued on crimes of breaching and misusing of government websites or its data, the municipality may impose fines as stated in the fines and fees schedules shown below, and refer the violator to the concerned authority.
      -  The subscription in the e-system of tenancy contracts is an annual subscription, which is valid from the date of the subscription request approval at the concerned department.
      - The signature of the subscriber on the request for the annual subscription in the e-system of tenancy contracts is considered as an explicit consent towards the undertaking to comply with terms, conditions, fees and fines set out in respect of the e-system.

- يجب أن يكون طالب الإشتراك السنوي في النظام الإلكتروني لعقود الإيجار مكتب عقاري يختص بإدارة العقارات وإيجار واستئجار الأراضي والعقارات بمختلف أنواعها، و تحمل رخص تجارية من دائرة التنمية الاقتصادية في الإمارة.
- تقع على المشترك مسؤولية الدخول على النظام الإلكتروني المعني من قبل الغير بعد تعهده في طلب الإشتراك بتحمل تبعات المسؤولية الجنائية والمدنية دون الرجوع على الغير أو انتظار الأحكام القضائية .
- يحظر على المشترك إدخال أي بيانات مغايرة للحقيقة أو مرفقات غير حقيقية يراد بها تنفيذ أي عملية من عمليات النظام الإلكتروني المعني وإلا كان للدائرة في تجاوز ذلك الحظر فرض الغرامات المالية المبية في قائمة الرسوم والغرامات أدناه وإحالة المخالف إلى السلطات المختصة .
- إن المشترك مسؤول مسؤولية تامة عما يتقاضاه من رسوم وغرامات مالية من قبل المستأجر بالنقد أو الأوراق المالية نيابةً عن الدائرة إثر سداده جميع المستحقات نيابةً عن المستأجر وفي حال نشوب أي خلافات مالية مع الغير فليس للمشترك الرجوع على الدائرة إلا أن للأخيرة امتياز الرجوع على المشترك في استيفاء مستحقاتها .
- لا تتحمل الدائرة مسؤولية تلف أو ضياع العمليات المالية التي لم يرد بيانها إلى النظام الإلكتروني المعني والتي قد تكون معرضة للقرصنة الإلكترونية لدى جهاز المشترك .
- للدائرة المعنية فرض الغرامات المالية المبينة في قائمة الرسوم والغرامات أدناه على المشترك في حالة تأخره عن تجديد عقد الإيجار بصفة شهرية .
- يكون الرسم العام لعقد الإيجار الإلكتروني متناسبا مع الرسم المعهود في احتساب قيمة العقد العادي .
- مع مراعاة كل القوانين والأحكام الصادرة بشأن جرائم خرق المواقع الإلكترونية الحكومية أو التلاعب بها أو ببياناتها من قبل أي شخص فإن للدائرة فرض الغرامات المالية المبية في قائمة الرسوم والغرامات أدناه وإحالة المخالف إلى السلطات المختصة .
- إن الإشتراك في النظام الإلكتروني لعقود الإيجار هو اشتراك سنوي يبدأ سريانه من تاريخ توثيق طلب الإشتراك لدى الدائرة المعنية.
- إن توقيع المشترك على نموذج طلب الإشتراك السنوي في النظام الإلكتروني لعقود الإيجار هو موافقة صريحة على التعهد والإلتزام بجميع الشروط والأحكام والرسوم والغرامات الواردة بشأن النظام المعني .
